Terms of service
Overview
Welcome to Evenline Wellness.
Evenline Wellness is operated by Kanova LLC (“Evenline,” “we,” “us,” or “our”). We operate this website, online store, and related content, features, tools, products, and services collectively referred to as the “Services.”
Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.
These Terms of Service (“Terms”) describe your rights and responsibilities when you access or use our Services.
By visiting our website, interacting with our Services, or placing an order, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, please do not use the Services.
Section 1 — Eligibility and Account Information
You must be at least the age of majority in your state, province, or country of residence to place an order through the Services.
When using the Services, you may be required to provide information such as your name, email address, shipping address, billing information, and payment details.
You agree that all information you provide is accurate, current, and complete and that you have the right to provide that information.
If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.
You may not sell, assign, transfer, or license your customer account to another person.
Section 2 — Products
We make reasonable efforts to describe and display our products accurately.
Product photographs, packaging, labels, colors, and appearance may vary slightly from what appears on your screen because of differences in device settings, photography, manufacturing updates, packaging revisions, or other factors.
We may update product descriptions, packaging, ingredients, availability, pricing, or other product information when appropriate.
We reserve the right to discontinue a product or limit quantities offered to any person, household, geographic area, or jurisdiction where permitted by law.
Nothing in these Terms limits any statutory consumer rights that cannot legally be excluded.
Section 3 — Dietary Supplement and Health Information
Products sold by Evenline may include dietary supplements.
Information provided through our website, advertisements, emails, product pages, educational materials, or other Services is provided for general informational purposes only.
It is not intended to constitute medical advice and should not be used as a substitute for advice, diagnosis, or treatment from a qualified healthcare professional.
Statements regarding dietary supplements have not been evaluated by the U.S. Food and Drug Administration unless expressly stated otherwise. Dietary supplements are not intended to diagnose, treat, cure, or prevent any disease.
Individual experiences and results may vary. Testimonials, reviews, customer experiences, and examples do not guarantee that every customer will experience the same results.
Before using a dietary supplement, you should consult a qualified healthcare professional if you:
-
are pregnant or nursing;
-
are under 18;
-
are taking medication;
-
have a medical condition; or
-
have questions about whether a product is appropriate for you.
Always follow the directions and warnings appearing on the product label.
Any satisfaction guarantee offered by Evenline is a customer-service and refund commitment and is not a guarantee of any particular medical, physiological, sleep, stress, performance, or wellness result.
Section 4 — Orders
By submitting an order, you are making an offer to purchase the products in that order.
We reserve the right to accept, reject, limit, or cancel an order where reasonably necessary, including in cases involving:
-
suspected fraud;
-
payment issues;
-
inaccurate pricing or product information;
-
product availability;
-
suspected unauthorized resale; or
-
violations of these Terms.
An order is not considered accepted until payment has been successfully processed and we have confirmed the order.
Please review your order carefully before submitting it.
Because orders may enter fulfillment quickly, we cannot guarantee that changes or cancellations can be made after an order has been submitted.
If we cancel an order after payment has been collected, the applicable amount will be refunded to the original payment method.
Purchases are also subject to our Refund Policy, including the terms of any applicable satisfaction guarantee.
Products purchased through our consumer store are intended for personal or household use and not for unauthorized commercial resale.
Section 5 — Prices, Taxes, and Billing
Prices, promotions, discounts, and offers may change without notice.
The price charged will be the price displayed at the time your order is submitted, subject to correction of obvious pricing or technical errors.
Unless otherwise stated, prices may not include:
-
shipping charges;
-
applicable taxes;
-
customs duties;
-
import fees; or
-
other government charges.
Where taxes, duties, or other charges are collected at checkout, the amount will be displayed before you complete your purchase.
International customers may be responsible for customs duties, import taxes, or other charges imposed by their destination country where those amounts are not collected at checkout.
You agree to provide accurate and current billing and payment information.
You represent that you are authorized to use the payment method submitted with your order.
Section 6 — Shipping and Delivery
Shipping and delivery estimates are provided for convenience and are not guaranteed.
Delivery may be affected by circumstances outside our reasonable control, including:
-
carrier delays;
-
customs processing;
-
weather;
-
transportation disruptions;
-
incorrect delivery information;
-
holidays; or
-
other events beyond our control.
If your shipment is delayed, lost, damaged, or does not arrive as expected, please contact us at:
We will review the circumstances and assist you where appropriate.
Nothing in this section limits rights you may have under applicable consumer-protection laws.
Section 7 — Returns, Refunds, and Satisfaction Guarantee
Returns and refunds are governed by our Return & Refund Policy.
Eligible Evenline purchases may be covered by our advertised 60-Day Satisfaction Guarantee, subject to the conditions stated in that policy.
If you have questions regarding a refund, damaged order, incorrect item, or satisfaction-guarantee request, contact:
Please do not mail products to Kanova LLC or to any address associated with Evenline unless our customer-support team specifically instructs you to do so.
Section 8 — Intellectual Property
The Services and their contents, including without limitation:
-
trademarks;
-
logos;
-
brand names;
-
product names;
-
text;
-
photographs;
-
graphics;
-
videos;
-
designs;
-
advertising materials;
-
page layouts; and
-
other original content
are owned by or licensed to Evenline, Kanova LLC, or their respective licensors and are protected by applicable intellectual-property laws.
The Services are provided for your personal, non-commercial use.
Unless we give you prior written permission, you may not reproduce, distribute, modify, publish, publicly display, sell, license, commercially exploit, or create derivative works from our protected content.
Evenline names, logos, product names, designs, and slogans may be trademarks of Kanova LLC or its licensors.
Third-party trademarks appearing through the Services remain the property of their respective owners.
Section 9 — Optional Third-Party Tools
We may provide access to tools, applications, integrations, payment services, analytics providers, or other services operated by third parties.
We do not necessarily control or monitor these third-party services.
Your use of third-party tools may be governed by separate terms and privacy policies maintained by those providers.
To the extent permitted by law, we are not responsible for harm resulting solely from your independent use of a third-party service outside our control.
Section 10 — Third-Party Links
The Services may include links to websites, services, or content operated by third parties.
We do not control and are not responsible for the accuracy, availability, policies, products, services, or practices of third-party websites.
You should review the applicable terms and privacy policies before interacting with third-party websites or completing transactions through them.
Section 11 — Relationship With Shopify
Evenline is powered by Shopify, which enables us to provide the Services to you.
However, purchases made through our store are transactions directly between you and Evenline.
Shopify is not the seller of Evenline products and is not responsible for the products purchased from us, except to the extent required by applicable law or arising from services Shopify independently provides.
Your use of Shopify-supported portions of the Services may also involve processing of information by Shopify in accordance with Shopify's applicable policies.
Section 12 — Privacy
Our collection and use of personal information is governed by our Privacy Policy.
Because our store is powered by Shopify, certain information may also be processed by Shopify and other service providers involved in operating our store, processing payments, fulfilling orders, preventing fraud, providing analytics, or delivering related Services.
Information may be processed or stored in countries other than the country where you reside, subject to applicable privacy laws and safeguards.
Please review our Privacy Policy for more information.
Section 13 — Reviews, Feedback, and User Content
If you voluntarily submit a review, testimonial, comment, photograph, suggestion, idea, or other content to us (“Feedback”), you represent that you have the right to provide it.
Unless otherwise prohibited by law, you grant Evenline a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, display, adapt, and distribute that Feedback in connection with operating, improving, and promoting our business and Services.
We may use customer reviews or testimonials in advertising or marketing where permitted by law.
You represent that your Feedback:
-
is truthful to the best of your knowledge;
-
does not violate another person's intellectual-property or privacy rights;
-
does not contain unlawful or malicious content; and
-
accurately discloses any material incentive or compensation associated with the submission where required by law.
We may remove Feedback that violates these Terms or applicable law.
Section 14 — Errors, Inaccuracies, and Omissions
From time to time, information on the Services may contain typographical errors, inaccuracies, or omissions relating to matters such as:
-
product descriptions;
-
pricing;
-
discounts;
-
promotions;
-
shipping costs;
-
availability; or
-
delivery estimates.
We may correct such errors and update information where appropriate.
If a material error affects an order you have already submitted, we may contact you to confirm the corrected information or cancel the affected portion of the order and provide any appropriate refund.
Section 15 — Prohibited Uses
You may use the Services only for lawful purposes.
You may not use the Services to:
-
violate applicable law;
-
infringe intellectual-property rights;
-
engage in fraud or deceptive conduct;
-
harass, threaten, defame, or harm another person;
-
transmit malware or malicious code;
-
interfere with the security or operation of the Services;
-
collect personal information about others without authorization;
-
send spam or other unauthorized commercial communications;
-
impersonate another person or organization;
-
circumvent access controls or security measures;
-
scrape, extract, reproduce, or commercially exploit material from the Services without authorization; or
-
use automated tools or artificial-intelligence systems in violation of Section 16.
We may suspend or terminate access to the Services where we reasonably believe these Terms have been violated.
Section 16 — Automated Systems and Agents
Automated software, artificial-intelligence agents, bots, crawlers, or other automated systems (“Agents”) may access the Services only where such access is permitted by us and complies with applicable technical restrictions.
Agents must not:
-
conceal that they are automated;
-
circumvent CAPTCHAs or other access-control measures;
-
bypass rate limits, robot exclusions, authentication systems, or security controls;
-
misrepresent themselves as human users; or
-
access the Services after we have expressly instructed the Agent or its operator not to do so.
We may restrict or block automated access where reasonably necessary to protect the Services, our customers, or our systems.
Section 17 — Termination
We may suspend or terminate access to some or all of the Services where permitted by law, including where we reasonably believe that a user:
-
violated these Terms;
-
engaged in fraud;
-
misused the Services; or
-
created a security or legal risk.
Termination does not affect obligations or liabilities that arose before termination.
Sections that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, disclaimers, limitation of liability, indemnification, governing law, and privacy.
Section 18 — Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
We do not guarantee that the Services will always be uninterrupted, error-free, secure, or continuously available.
Except for warranties or guarantees expressly provided by Evenline or required by law, we disclaim implied warranties to the fullest extent legally permitted.
Nothing in these Terms excludes, limits, or modifies any warranty, guarantee, condition, consumer right, or remedy that cannot lawfully be excluded or limited.
Our 60-Day Satisfaction Guarantee, where applicable, is governed separately by our Refund Policy.
Section 19 — Limitation of Liability
To the fullest extent permitted by law, Evenline, Kanova LLC, and their respective officers, employees, affiliates, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising out of or related to your use of the Services or products purchased through the Services.
This may include, where permitted by law, loss of profits, revenue, savings, data, opportunity, or similar economic losses.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Nothing in these Terms limits any mandatory consumer-protection right or remedy available to you under applicable law.
Section 20 — Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Kanova LLC, Evenline, and their affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims arising from:
-
your material violation of these Terms;
-
your unlawful use of the Services; or
-
your infringement of the lawful rights of another person.
This obligation will not apply to the extent a claim results from our own unlawful conduct or negligence where liability for such conduct cannot lawfully be excluded.
Section 21 — Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law.
The remaining provisions will remain valid and enforceable.
Section 22 — Waiver and Entire Agreement
If we do not immediately exercise or enforce a right under these Terms, that does not constitute a waiver of that right.
These Terms, together with policies incorporated by reference, constitute the agreement between you and Evenline concerning your use of the Services.
These Terms do not override consumer rights that cannot legally be waived.
Section 23 — Assignment
You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
We may transfer or assign our rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, corporate restructuring, or other lawful business transaction.
Any assignment will remain subject to applicable law.
Section 24 — Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, except where the mandatory laws of your place of residence provide otherwise.
To the extent permitted by applicable law, disputes arising from these Terms or the Services will be subject to the jurisdiction of the appropriate state or federal courts located in Wyoming.
Nothing in this section deprives a consumer of protections or legal rights that cannot lawfully be waived under the laws applicable to that consumer.
Section 25 — Changes to These Terms
We may update these Terms from time to time to reflect changes to:
-
our Services;
-
applicable law;
-
our business practices; or
-
operational requirements.
The most current version will be posted on this page.
Where required by law, we will provide additional notice of material changes.
The “Last updated” date at the top of this page indicates when the Terms were most recently revised.
